The Texas Department of Public Safety is suing the Department of Public Safety over new rules requiring police officers to wear waist sizes below a certain size.

According to information released by the TDPSO on Wednesday, the state has issued a command presence policy that places limits on the physical size of officers working in the state. One of those restrictions is their waist – men must be no larger than 40 inches and women no larger than 35 inches.

If an officer’s waist exceeds that measurement, they are given a pair of other tests that measure height, weight and approximate body composition. Soldiers who fail these tests may be subject to disciplinary action, including reassignment, suspension from overtime, or being passed over for promotion.
The lawsuit was filed Wednesday by DPSOA in Travis County District Court. He is asking the Court to temporarily injunction the Attendance Management policy until the legality of the soldiers’ waistline rating is determined.
Officers said Friday, “We demonstrate every day that we’re capable of doing our job,” and it’s unclear what they’re trying to do with the restrictions.
He noted that if the waist standard had been at the time of last year’s military health check, 22% of the officers would have failed it.

State law requires that fitness standards be determined with the help of a qualified consultant. The lawsuit alleges that the consultant last met state fitness requirements in 2006 and that DPS has revised and changed the test annually to determine what constitutes a passing grade.
The suit also alleges that waist measurements violate state law that requires fitness tests to be directly related to the duties police officers perform.
Jankowski said in a statement: “Not all physically fit soldiers have the same body type, height or genetic make-up. Soldiers have been subject to fitness standards for more than a decade. The new standards go beyond fitness testing. to perform their duty as an officer, engage in artificial politics that have little to do with the officer’s ability to keep Texans safe.”
In addition to scrapping the waist measurement standards, the lawsuit calls for several other criteria added to the test since 2006, including a timed run and an increase in the number of push-ups and sit-ups.
